1. Introduction
Please ensure that the first named person listed on the Booking Form has read and signed the declaration at the bottom of the form. It is the responsibility of this named individual to ensure that each person listed on the booking form has read and agrees to the terms of the Booking Conditions set out below:
Once you have made your reservation, SwimTrek will send you a Booking Confirmation and the following:
- Tour Itinerary.
- Arrival & Departure Information.
- Meeting point and time.
- Equipment Checklist.
- Training Plan.
- Insurance Requirements.
2. Nature of the Trips
Open water swimming inherently requires a degree of on-trip flexibility. For safety, we rely on decent weather conditions when carrying out the crossings. Therefore changes in planned itinerary will not be uncommon and will add to the uniqueness of the tour.
3. Getting to the Start Point
It is your responsibility to get to the start point at the correct time. We will of course provide assistance where possible as well as putting you in touch with other members of the group to make travel arrangements etc.
4. Holiday & Activity Insurance
If travelling outside your home country, you must be covered by insurance, which must include adequate cover for baggage, medical expenses, cost of repatriation should you become too ill to continue. It is also essential that you are insured for the activities that you wish to do on the holiday. If you are an EU resident travelling to other EU states, you should also take an European Health Insurance Card with you. We can advise on specific policies which would be suitable.
5. Trip Descriptions & Prices
The trip descriptions, prices and booking conditions in this brochure are accurate at the time of printing and published in good faith. However, due to currency fluctuations, rising costs and changing travel conditions overseas, SwimTrek reserves the right to modify the price and itinerary.
6. Payment
Please note payment of a deposit by credit card is not subject to a surcharge. However, if the final balance is paid by credit card this will attract a 1.6% surcharge. To avoid this surcharge you can either pay by Debit card or mail a cheque to SwimTrek.
7. Final Payment Due Date
All final payments are due no later than 8 weeks before commencement of the trip, if we do not receive the balance by this date it may result in the cancellation of your place on the trip.
8. Cancellation policy - *ALL DEPOSITS ARE NON-REFUNDABLE*
If you or a member of your group wishes to cancel their holiday the following charges apply:
- 8 or more weeks Loss / Transfer of deposit to another trip
within the calendar year
- Between 8 and 4 weeks SwimTrek retains 70% of your full tour price.
- Less than 4 weeks SwimTrek retain 100% of your full tour price.
All SwimTrek trips are based on group arrangements involving a minimum number of clients. If this minimum number is not reached, we reserve the right to cancel the departure and offer an alternative date or a refund of all monies paid by you. We cannot accept any liability for compensation beyond this full refund. SwimTrek cannot be held responsible for any changes or cancellations to your trip due to wars, threat of war, terrorism, industrial action, civil strike, airport closures or congestion, fire, technical problems, weather or any other difficulties beyond our control.
9. If you Change your Booking
An administration fee of £25 per booking plus any additional cost incurred will be charged if a confirmed booking is changed or transferred to a different departure date or tour, up to 8 weeks prior to departure. Your new booking must be taken within the same calendar year. Changes are subject to availability.
10. Medical Requirements
Good physical and mental health are essential for the enjoyment of these active, outdoor trips. By forwarding the Booking Form, the client certifies that he/she does not have any physical or other condition of disability that would create a hazard for himself/herself or other passengers.
It is essential that any participant with a medical condition requiring regular treatment or which may be affected by rigorous activity, cold, heat etc, notify SwimTrek in advance of travel.
11. Passport/Visa
A valid passport is required for all international travel with an expiry date of at least six months after your return. Please verify if you require a visa for the country to which you are travelling. All clients are responsible for obtaining their own visa.
12. Swimming Ability Levels
Participants joining our Adventure Swimming Holidays must read the Tour Summary and ensure that they have an appropriate level of fitness and swimming ability for the tour in question.
13. Acceptance of Risk
Please be assured that SwimTrek will always do the utmost to ensure your safety and well-being when on tour. However, you accept that on all tours, there are some inherent risks that cannot be covered against by SwimTrek. Therefore on day 1 of the tour you will be given a briefing, following which, you will need to sign a form indicating that you have read and understood it. The purpose of this form is to make you aware of the risks involved with the trip and to indemnify any service providers and SwimTrek from any claims made by you for incidents arising due to circumstances outside the service provider’s and SwimTrek’s reasonable control. 14. Your Financial Protection
In compliance with the UK Package Travel, Package Holidays and Package Tours Regulations 1992 an insurance policy has been arranged with Travel & General Insurance Company plc to protect customers’ prepayments paid in respect of non-flight inclusive packages commencing and returning to the UK.
the ground handling aspects of packages where the customer is responsible for arranging travel to the destination offered in this brochure / literature / document / on this website (subject to the terms of the insurance policy), for:
a refund of such prepayments if customers have not yet travelled, making arrangements to enable the holiday to continue if customers have already travelled in the unlikely event of our financial failure.”
15. SwimTrek competition Terms and conditions.
These apply to all SwimTrek (ST) competitions unless (and to the extent that) the competition states otherwise. Competitions are open to all UK and ROI residents (however if a person wins a ST holiday and is under the age of 18, the winner will need to accompanied by a legal guardian aged 18 or over), except employees of SwimTrek (ST), promoters supplying prizes associated agencies and their families or any other person(s) connected with the competition. Entries will not be considered after the closing date. Entries will not be returned or acknowledged, ST reserves the right to publish entries (or parts of entries) other than the winning entry and publication does not mean that the entrant has won the prize. ST reserves the right to edit entries in its discretion for publication. Entrants will retain copyright in their submitted entries however, by entering all entrants license ST a worldwide royalty-free perpetual license to edit, publish and use each entry in any and all media (including print and online) for publicity purposes by ST and news purposes. By entering winners agree to their names and general locations being used for publicity purposes by ST in any and all media. Only one entry per customer. ST will not be responsible for any failure or receipt of entries. ST takes no responsibility for delayed, mislaid, lost, illegible, incomplete or damaged entries. The winner(s) will be the first correct entry(ies) drawn at random after the closing date. The judge’s decision is final. Winners will be notified within 28 days of the closing date. For a list of winners please send an SAE to SwimTrek Swimming Adventure Holidays, 63 Lansdowne Place, Brighton & Hove, BN3 1FL, stating for which competition you would like the winners details. Prizes are subject to availability. Prizes are as stated and are non-transferable and cash alternatives are not available. When applicable, partner airlines’ conditions of carriage apply. Passports and visas, as well as vaccinations and insurance are winners’ responsibility. Travel to and from London departure points is the winners’ responsibility. Any breach of these rules by the entrant will void their entry. Misrepresentative or fraudulent entries will invalidate an entry. ST reserves the right at any time to cancel, modify or supersede the competition (including prizes) if, in our sole discretion, a competition is not capable of being conducted as specified. Other than death or personal injury arising from acts or omissions of ST or it employees, ST will not be liable for any loss or damage arising out of the winners’ (or their guests) enjoyment of the prize. 16. SwimTrek Photography competition
Upload your pictures to our photo gallery, with your name, address and a caption or send the picture to SwimTrek photo competition, 63 Lansdowne Place, Brighton, BN3 1FL or email info@swimtrek.com. All formats acceptable. Open to amateurs in the UK. This is a rolling competition with no closing date. Each month a picture will be chosen by teh swimTrek team and placed in the e-newsletter. The winner will only receive a prize (as listed on the SwimTrek website and / or the SwimTrek e-newsletter) if they email info@swimtrek.com with their name and trip information to correctly identify that the picture featured was indeed taken by them within 30 days of broadcasting of the relevant SwimTrek e-newsletter. If you’d like your pictures returned, please send an SAE stamped with the correct postage to SwimTrek Swimming Adventure Holidays, 63 Lansdowne Place, Brighton & Hove, BN3 1FL. Photographs submitted at owners risk. No responsibility can be taken for lost or damaged entries. Digital images should be supplied as a 300-dpi high-resolution file. The images will not be used other than to promote the SwimTrek competition.
17. Gift Voucher Terms and Conditions distributed during 2009.
- The SwimTrek gift voucher is worth £75 when booking a Swimtrek holiday greater than 3 days in length. If your booking if for a short escape of 3 days or less, the voucher will be worth £35.
- The SwimTrek gift voucher can only be exchanged for SwimTrek holidays based in the UK & Meditteranean.
- The voucher cannot be redeemed against day trips or charity challenges.
- The promotion is valid from the date the voucher is given and only applies to trips for 2009 & 2010.
- The voucher cannot be redeemed for cash.
- This voucher cannot be used in conjunction with any other SwimTrek promotion or voucher.
18. ZOGGS 10% off discount.
- The ZOGGS 10% discount is valid on any booking made before September 20th 2010 and SwimTrek must be informed of the customer's intention to use the discount within 7 days of the booking being made.
- The discount cannot be redeemed against merchandise or charity challenges.
- The voucher cannot be redeemed for cash.
- The discount cannot be used retroactively (ie against trips already booked) or against trip amendments and transfers.
- This voucher cannot be used in conjunction with any other SwimTrek promotion or voucher.
